1. ACCEPTANCE OF TERMS
Welcome to Jet Auto Wash. By accessing our website at jetautowash.com, using our mobile application, visiting our physical location at 1500 Highland Road West, Kitchener, Ontario N2N 3K6, Canada, or using any of our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.
2. SERVICES OFFERED
Jet Auto Wash provides express car wash services including: Single-visit car wash packages (Quality, Super, Ultimate)
Monthly unlimited wash memberships (Wash Club)
Self-service vacuum stations
Pre-wash power wands Mobile app for membership management
Gift card purchases
Specific terms for Wash Club memberships are outlined in our separate Wash Club Terms and Conditions
3. USE OF SERVICES
3.1 Eligibility
You must be at least 16 years of age to use our services. If you are under 18, you must have parental or guardian consent.
3.2 Vehicle Requirements
By using our car wash services, you represent and warrant that:
Your vehicle is suitable for automated car wash systems
All loose items, antennas, and accessories have been removed or secured
Your vehicle does not have excessive mud, snow, or ice buildup (pre-wash power wands are available for this purpose)
Windows, doors, sunroof, and trunk are properly closed
Side mirrors are in the standard position
3.3 Prohibited Vehicles
Vehicles with cracked or damaged windshields or windows
Vehicles with loose body parts, rust holes, or damaged paint
Vehicles with aftermarket modifications that may be damaged by washing
Oversized vehicles exceeding our tunnel clearance specifications
Vehicles leaking fluids
4. LIMITATION OF LIABILITY
4.1 Pre-Existing Damage
Jet Auto Wash is not responsible for damage to vehicles that existed prior to the wash service, including but not limited to:
Cracked or chipped windshields or windows
Loose or damaged trim, molding, or emblems
Pre-existing paint damage, scratches, or rust
Antenna damage (all antennas should be removed)
Damage to aftermarket accessories or modifications
4.2 Items Left in Vehicle
Jet Auto Wash is not responsible for items left inside vehicles or damage to items that should have been removed before washing, including but not limited to:
Removable antennas, bike racks, or roof accessories
Unsecured items on dashboards or in truck beds
Personal belongings left inside the vehicle
4.3 Maximum Liability
In the event that Jet Auto Wash is found liable for damage to your vehicle, our maximum liability shall be limited to the lesser of:
$500 CAD, or
The actual cost to repair the damage as determined by a qualified repair facility of our choosing
Claims must be reported immediately to staff on-site before leaving the premises. Claims reported after leaving the property may not be honored
4.4 No Consequential Damages
Jet Auto Wash shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of use, rental car costs, or any other losses
5. WEBSITE AND MOBILE APPLICATION
5.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
5.2 Accuracy of Information
You agree to provide accurate, current, and complete information when creating an account or making purchases. You agree to update this information to keep it accurate and current.
5.3 License and Restrictions
We grant you a limited, non-exclusive, non-transferable license to access and use our website and mobile application for personal, non-commercial use. You may not:
Modify, copy, distribute, or create derivative works based on our services
Reverse engineer, decompile, or attempt to extract source code
Use our services for any illegal or unauthorized purpose
Interfere with or disrupt the integrity or performance of our services
Attempt to gain unauthorized access to our systems or networks
6. PRICING AND PAYMENT
6.1 Pricing
All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. Current pricing is available on our website, mobile app, and at our facility.
6.2 Payment Methods
We accept credit cards, debit cards, and other payment methods as displayed at our facility and in our mobile app. Payments can also be made at the on-site Shell convenience store. All payments are processed securelythrough third-party payment processors.
6.3 Taxes
All prices are subject to applicable federal and provincial taxes, including HST (Harmonized Sales Tax) as required by law.
7. GIFT CARDS
Gift cards purchased from Jet Auto Wash:
Have no expiration date unless required by law
Are not redeemable for cash except where required by law
Are not replaceable if lost, stolen, or damaged
May only be used at Jet Auto Wash locations
Cannot be combined with certain other offers or promotion
8. INTELLECTUAL PROPERTY
All content on our website, mobile app, and marketing materials, including but not limited to text, graphics, logos, images, and software, is the property of Jet Auto Wash or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
The Jet Auto Wash name, logo, and all related marks are trademarks of Jet Auto Wash. You may not use our trademarks without our prior written permission.
9. PRIVACY AND DATA COLLECTION
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of personal information as described in the Privacy Policy
10. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Jet Auto Wash, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
Your use or misuse of our services
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations
11. SERVICE INTERRUPTIONS
Jet Auto Wash reserves the right to:
Close our facility for weather conditions, holidays, maintenance, or equipment failure
Refuse service to any customer for any reason
Modify our hours of operation with or without notice
Discontinue or modify our services at any time
We are not liable for any losses or damages resulting from service interruptions or closures.
12. GOVERNING LAW AND DISPUTE RESOLUTION
12.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
12.2 Jurisdiction
Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
12.3 Dispute Resolution
Before filing any legal action, you agree to first contact us at info@jetautowash.com to attempt to resolve the dispute informally.
13. SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
14. WAIVER
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
15. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and Wash Club Terms and Conditions, constitute the entire agreement between you and Jet Auto Wash regarding the use of our services.
16. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after changes have been posted constitutes your acceptance of the modified Terms.
